CASE OVERVIEW: Marin & Barrett, Inc. is extremely pleased to report that domestic simple assault and domestic disorderly conduct charges that had been pending against a Client in the Kent County District Court have been dismissed. Our Client had been charged with the domestic simple assault and domestic disorderly conduct charges after the Police were called in March of 2020 to a domestic incident where the complaining witness alleged that the Client had thrown bleach in her face. After a cursory investigation, our Client was charged with domestic simple assault and domestic disorderly conduct. Based on the nature of the charges, if convicted our Client faced a maximum sentence of up to one year in jail (ACI) on the assault charge and up to six months in jail (ACI) on the disorderly conduct charge.
Once hired to defend the case, Attorney Barrett was able to point out a stunning lack of evidence to support the complaining witnesses allegations. Namely, that there was no bleach at the home and the complaining witness did not point to or have any injury or evidence of being struck with bleach. Ultimately, confronted with these facts the complaining witness became uncooperative with the Prosecution and they were forced to dismiss all charges.
