Felony Domestic Violence Charges Dismissed in the Washington County Superior Court on 8/28/2020

CHARGES:
(1) DOMESTIC VIOLENCE - ASSAULT ON A PERSON OVER 60 CAUSING BODILY INJURY (R.I.G.L 11-5-10)
(2) DOMESTIC VANDALISM (R.I.G.L. 11-44-1)
(2) DOMESTIC DISORDERLY CONDUCT (R.I.G.L. 11-45-1)
CASE OVERVIEW: Attorney Kensley Barrett with Marin & Barrett, Inc. is extremely pleased to report that the charges of domestic violence - assault on a person over sixty causing bodily injury, domestic vandalism, and domestic disorderly conduct have been dismissed in the Washington County Superior Court. Our Client had been charged with the the three domestic violence offenses after an alcohol related incident in September of 2019. The Police were dispatched to the home for a report of screaming. The Police observed injuries consistent with a struggle on our Client's husband and, due to his age (72), she was arrested and charged with the above-referenced offenses. Based on the nature of the charges, if convicted she faced a maximum sentence of up to five years in jail (ACI) on the domestic violence - assault on a person over 60 causing bodily injury charge alone.
Once hired to defend the case, Attorney Barrett was able to work with the complaining witness (our Client's husband) and get them in contact with the Prosecution. After an effective line of communication was opened up between the our client's husband and the Prosecution, negotiations quickly turned positive and the Prosecution dismissed all charges and we are in the process of having them entire case expunged from our Client's record.
