Client Charged with Domestic Assault Found Not Guilty After Trial in February 2022

CASE OVERVIEW: Attorney Kensley Barrett with Marin & Barrett, Inc. is extremely pleased to report that a Client charged with domestic simple assault and disorderly conduct was acquitted after trial in District Court. The Client was charged with the domestic offenses by the North Providence Police Department after a domestic dispute with his wife. The Client's wife alleged that he pushed her during an argument at their house in front of their child. The Client did admit to pushing his wife but reported that it was in self-defense.
During the trial, Attorney Barrett cross examined the prosecution's witnesses, including the alleged victim and the North Providence Police officer who arrived on scene following the incident. Specifically, Attorney Barrett was able to get the alleged victim to admit that this was an instance of “mutual combat” more so that an actual assault on behalf of the Client. Subsequently the judge found the Client not guilty after hearing all of the facts. As a result, the “no-contact order” against the Client was terminated and the Client's record is preserved allowing for the case to be sealed (expunged) from his record.
