Case Overview
At The Law Offices of Kensley Barrett, me and my team handle some of the most serious criminal allegations a person can face. In this case, our client was charged with Second Degree Sex Assault in Washington County District Court, Rhode Island, following an investigation by the University of Rhode Island Police Department.
The allegation stemmed from an alleged on-campus incident in October 2019, when the client was a student living at the University of Rhode Island. In March 2022, more than two and a half years after the alleged incident, a woman reported that the client had sexually assaulted her by touching her breast in his dorm room.
The Defense
After negotiations with the State failed, the case was scheduled for trial. In preparing for trial, Attorney Ken Barrett conducted a detailed review of the charging documents and procedural history. During that review, Attorney Barrett identified a critical legal defect: the statute of limitations for the charged offense is three years, and the Rhode Island Attorney General's Office filed the official criminal complaint after that period had expired.
Because the statute of limitations had run, the State was legally barred from prosecuting the charge.
Attorney Barrett immediately filed a motion to dismiss, asserting that the case could not proceed due to the statute of limitations violation.
The Outcome
Following a brief hearing, the court granted the motion to dismiss, resulting in the complete dismissal of the charge. This outcome spared the client from trial and, critically, avoided the possibility of sex offender registration, which would have carried lifelong consequences.
