In a complex case arising out of an emotional dispute, our Client was charged with serious domestic-related offenses following an incident that took place in Westport. After a day out, a disagreement between our client and his girlfriend escalated as they returned home. During the drive, the girlfriend attempted to exit the vehicle near a hotel. The events that followed, partially captured on high-definition hotel security footage, formed the basis of the criminal charges brought by the Westport Police.
According to the police, the footage showed our client pursuing the complainant multiple times—allegedly tackling her and returning her to the vehicle on two occasions, before she was able to escape and seek refuge in the hotel lobby on a third attempt. Based on this evidence, the client was charged with Domestic Kidnapping, Intimidation of a Witness, and Assault and Battery on a Family or Household Member.
Attorney Jason Ollman took the lead in defending the client, beginning with a thorough review of the surveillance footage and the accompanying police reports. After closely analyzing the applicable legal standards, Attorney Ollman filed a motion to dismiss the Intimidation of a Witness charge, successfully arguing that the facts alleged did not support the statutory elements required. The Court agreed and granted the Defense's Motion to Dismiss.
Attorney Ollman continued to work diligently to protect the client's interests. By presenting additional context and mitigating information—including background on the relationship and the emotional state of the parties involved—he was able to highlight that the incident, while serious, did not rise to the level of criminal intent required to support a conviction for kidnapping. After extensive discussions with the prosecution and the Court, a resolution was reached: the remaining charges would be continued without a finding (CWOF) for one year.
This outcome spares the client from a criminal conviction, provided that he remains arrest-free and complies with the terms of the CWOF. It also preserves his opportunity for a future dismissal and sealing of the case.
