The client was allegedly observed drifting from the middle lane into the right lane while driving eastbound on Route 195. Following the stop, the client was asked to perform Standardized Field Sobriety Tests (SFSTs) and was later taken to the State Police Barracks, where they submitted to a breathalyzer test that registered a .06 blood alcohol concentration (BAC) — well below the legal limit of .08.

The Defense

Despite the breath test showing a BAC under the legal threshold, the Commonwealth pursued both OUI and negligent operation charges. Attorney Ken Barrett set the matter for a jury trial, where he focused on the lack of credible evidence of impairment or unsafe driving.
