The client was allegedly observed drifting from the middle lane into the right lane while driving eastbound on Route 195. Following the stop, the client was asked to perform Standardized Field Sobriety Tests (SFSTs) and was later taken to the State Police Barracks, where they submitted to a breathalyzer test that registered a .06 blood alcohol concentration (BAC) — well below the legal limit of .08.

The Defense

Despite the breath test showing a BAC under the legal threshold, the Commonwealth pursued both OUI and negligent operation charges. Attorney Ken Barrett set the matter for a jury trial, where he focused on the lack of credible evidence of impairment or unsafe driving.

During the one-day trial, Attorney Barrett emphasized that a .06 reading is not evidence of intoxication, and the field sobriety tests were subjective and inconsistent. The defense argued that the Commonwealth's case rested on speculation rather than proof beyond a reasonable doubt.

The Outcome

After hearing all the evidence, the jury agreed with Attorney Barrett's arguments and returned a not guilty verdict on both the OUI and Negligent Operation charges. This result ensured that the client faced no license suspension, no criminal record, and no penalties.
