Case Overview

In this case, our client faced an Operating Under the Influence (OUI) charge out of Natick District Court, stemming from a single-car accident in 2015.

After missing the original court date, the client was issued a default warrant. When the client reached out to our firm, Attorney Ken Barrett immediately took action to resolve the outstanding warrant and begin preparing a defense to fight the OUI charge.

The Defense

Attorney Barrett first succeeded in having the default removed and the warrant lifted, allowing the case to move forward properly. From there, our team focused on the critical piece of evidence: the breathalyzer test results, which showed a .10 blood alcohol concentration (BAC) — slightly above the legal limit of .08.

Attorney Barrett filed a motion to suppress the breathalyzer results, challenging the admissibility and reliability of the evidence. After reviewing the arguments and the circumstances surrounding the testing, the court granted the motion, effectively removing the BAC evidence from the case.

The Outcome

With the breathalyzer results suppressed, Attorney Barrett set the matter for a bench trial (no jury). After a one-day trial, the judge found the client not guilty of OUI. Thanks to this result, the client avoided all criminal penalties, license consequences, and the long-term impact of an OUI conviction.
