Case Overview

Police arrived at the client's residence to execute an arrest warrant. Despite the client expressly stating that officers did not have permission to enter the home, Marshfield Police entered the residence and conducted a search. During that search, officers located and seized several firearms that were outside of a safe, leading to the firearm storage charge.
The Defense
Attorney Ken Barrett immediately challenged the legality of the police conduct. After reviewing the facts and constitutional issues involved, Attorney Barrett filed a motion to suppress, arguing that:
- Police entered the client's home without a valid search warrant

The Outcome
After reviewing the motion and legal arguments, the Commonwealth ultimately agreed that the evidence should be suppressed. As a result, the case was dismissed with prejudice, meaning the charge could not be refiled against the client.
Even more importantly, the matter was expunged from the client's record the very same day, ensuring that the charge would not continue to impact the client's future.
